The U.S. Congress is considering major changes to the jurisdictional mandate of the Federal Trade Commission, including in its ability to regulate advertising. These changes, which would transform a regulatory structure that has worked well since the 1970’s, have received very little scrutiny through the normal process of congressional hearings and debate.

H.R. 3126, the Consumer Financial Protection Agency Act, would create a new agency with wide jurisdiction over many financial services. The jurisdiction would extend to the advertising of those products, which currently resides with the FTC. While the FTC would seemingly lose some authority, its powers would be greatly expanded over those areas where jurisdiction remains. The legislation would do away with many of the protections previously enacted by Congress to protect industry from the over-reaching of the Federal Trade Commission in the 1970’s. The bill is waiting to be considered by the full House of Representatives. 		<item><title>Alert: Major Commercial Speech Case</title><description>As you know, earlier this year Congress passed, and President Obama signed into law, a measure greatly restricting commercial speech – a measure which in our view is unconstitutional.

The restrictions are part of a broader law giving the Food and Drug Administration jurisdiction over tobacco, including tobacco advertising. Specifically it directs the Secretary of Health and Human Services to publish a rule banning all outdoor advertising for tobacco within 1,000 feet of any elementary or secondary school or playground and require all tobacco advertising be limited to black text on a white background except in magazines, newspapers or periodicals with readership of at least 85% adults. </description><link>http://www.aaf.org/default.asp?id=1066</link><pubDate>Tue, 03 Nov 2009 12:30:16 -0500</pubDate></item>

			<description>We have learned that Senator Bill Nelson, D-Fla. does not intend to offer an amendment to the healthcare reform legislation to eliminate deductibility for pharmaceutical advertising. He had previously stated his intention to do so in a letter to the St, Petersburg Times and in a constituent newsletter.

The Senator has not disclosed reasons for his change of heart, but it is our belief that the strong response from the ad industry played a role in this decision. </description>

			<title>Alert: Threat to Advertising Deductibility Renewed</title>
			<description>Last week Senator Bill Nelson, D-Fla., sent a letter to the editor of the St. Petersburg Times in which he stated his intention to offer an amendment to healthcare reform “eliminating the tax break drugmakers get for TV advertising.” 

You probably recall that a similar idea was considered, and rejected, last June when the House Ways and Means Committee drafted their version of healthcare reform legislation. 

Senator Max Baucus, D- Mont., Chairman of the Senate Finance Committee has stated his intention to release the compromise legislation drafted by the so called “gang of six” Democratic and Republican members of the Committee later this week.  Senator Nelson is not a part of that group, but does sit on the Finance Committee.  </description>

			<description>In a major piece of good news for the advertising industry, the healthcare reform revenue proposals released by the House Ways and Means Committee last week do not include the much discussed provision to take away the federal tax deduction for prescription drug advertising.

Instead, the committee would impose a surtax on individuals earning at least $280,000 in adjusted gross income and couples earning more than $350,000, according to Chairman Charles Rangel, D-N.Y. </description>

The Ways and Means Committee is scheduled to release it's list of revenue options for healthcare reform on Friday. We are down to the final hours that we have to convince members of the committee and others in the House of Representatives, that it would be bad policy and very harmful to media and advertising industries to impose a tax on the advertising of prescription medications. By denying the ordinary and necessary business expense deduction for this advertising, it would be the first time in history that the Congress would have targeted one form of speech and made it more expensive in order to discourage people from speaking. </description>

			<description>It is with great sorrow that we announce the passing of Chan Bell, beloved wife of AAF President Emeritus Howard Bell.

Howard and Chan enjoyed 61 glorious years together. Chan was always at Howard’s side as a true partner and companion in both their personal life and Howard’s professional career. Chan was known as “Ma Bell” to all who adored her. District 19 was created by Chan Bell, and she was its heart until she passed the torch to Jean Snyder after Howard's retirement. Even after Chan and Howard formally retired from the AAF, Chan was always a regular attendee and participant in all of the AAF’s events. Everyone who has ever been a member of the AAF understands that it is people like Chan who have made the AAF a loving family. </description>
