Re: California Senate Bill 773


California State Senator Jackie Speier's (District 8, San Francisco) legislation that would severely hamper the ability of businesses to communicate with their own client base as well as that of their associates will go before the State Senate this week. The bill unfairly discriminates among businesses based on their size and organization.

This bill should be voted on within the next four to five days. Immediate action must be taken to educate lawmakers about the devastating effects of the bill on industries outside of financial services.

Senate Bill 773, the Financial Information Privacy Act of 2002, would require advertising and marketing businesses, not just the financial services providers the bill is aimed at, to provide "opt-out" before sharing client information with the other components of their company and an "opt-in" before sharing client information with an affiliated organization.

Specifically the bill would do the following:

  • Require a company to provide "opt-out" before marketing a product to its own clients.
  • Demand "opt-in" before information is shared with affiliated businesses for any purpose.
  • Consider any information collected by an Internet "cookie" personally identifiable information.

The AAF believes that a consumer deserves notice, choice and consent regarding the use of personal information. SB 773 goes beyond those reasonable measures and those of the Gramm-Leach-Bliley bill by requiring multiple "opt-in" or "opt-out" exercises and providing consumers with a false sense of security by placing the sole responsibility for the security of their personal information on business regardless of external criminal attempts to access the information through hacking.

Bill 773 is flawed because it:

  • Limits legitimate business communication and activities beyond the financial services sector.
  • Applies different standards of client approval for marketing and advertising based on a business's size or organization in such a way that impedes communication between business and client.
  • Sets a dangerous precedent governing business activity among affiliates.

There is an alternative to SB 773 in Governor Gray Davis's privacy bill.

Personal information should not be bought, sold or traded without permission but business communication and marketing should not be hampered by unnecessary and ineffective legislation.

Please contact your lawmakers and urge them to oppose Senate Bill 773.
